Marbella Property. Co – A company not to be trusted, run by a liar, cheat and thief
James Scurrah & his half-brother David Mahony – They steal clients funds by taking reservation Deposits and when you do not successfully complete a sale through no fault of your own as a lot of the properties do not return what are 100% refundable deposits. We were shown illegal builds all with faults and problems which you are not advised about but when you find out near completion and step back, they think it is okay to keep. Despite a court verdict in our favour we are still to be paid the court judgement and Scurrah has emptied his bank account and hidden assets to stop then being seized.

Mr Scurrah – In response to the wildly inaccurate statement below please allow me to correct a few points that can be fully backed up in writing with dates as I have every email since this whole sorry issue began.
We did meet in your office where David Mahony brought me and I also met Joe & Arthur in the back office who look after your IT and at the time were compiling a list of properties to view that met my brief. A service offered not requested, having made an enquire about a single property.
I was offered to be collected at the airport and shown a few properties, David also explained and showed me the level of commission that more than covered any expenses experienced. Having lodged a reservation deposit with Marbella properties (a bank account in your name) the first property which Viva were marketing fell through, the reasons are unimportant and when I asked for the deposit to be returned I was told that Viva would not return it until 30 January 2015 (second extension date) which while not happy accepted what I was being told.
Both my wife and I returned to Spain again at the invitation of David who had found more properties for us to view. This time we found one with Grapevine but on the second viewing were advised that the property was not regulated. While it was an on-going situation and advised that it would be regulated we left it and returned home the negotiations continuing and deal almost agreed subject to regulation. Then having found an existing demolition order existed we again asked for the reservation deposit to be returned and would stand back for a while, that is when it went sour as all the excuses and whereabouts of who held our money became a but thin and David Mahony started to contradict himself. The trouble with being a sociopathic liar is not having a fantastic memory you begin to trip yourself up.

I having been a General Manager with a large private motor group for 32 years and know how to conduct myself even in stressful conditions so your claims about my behaviour are unfounded though I did hi-light Mr Mahony’s contradictions.
I will copy this to Manzarares who represent me in Spain and Russel Aitken in the UK along with Viva Estates and Grapevine so that everybody is aware of the claims you are making and how you or your employees treat clients, at no time did David Mahoney portray himself as anything other and only claimed to be acting on his own when the claim was lodged against you.
As the innocent party here who did nothing wrong I am not about to walk away until what is due to me is paid.

With regards to damaging your business, the only people who are doing that are David Mahony and yourself.
